Terms of Service
These Terms of Service ("Terms") govern your access to and use of kingdomkonstruction.com (the "Site") operated by Kingdom Konstruction ("we," "our," or "us"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. About These Terms
These Terms cover only your use of this Site. They are not a construction contract. Any actual construction work we perform for you is governed by a separate signed agreement between you and Kingdom Konstruction.
2. Use of the Site
You may use this Site to learn about our services, request quotes, schedule inspections, and contact us. You agree to use the Site only for lawful purposes and not to:
- Submit false, misleading, or fraudulent information through any form
- Attempt to disrupt, damage, or gain unauthorized access to the Site or its systems
- Use the Site to send spam or unsolicited communications
- Scrape, copy, or republish Site content for commercial purposes without our written permission
3. Quote Requests & Inspections
Quote requests, free roof inspection requests, and other forms submitted through the Site are requests for service, not binding contracts. A binding agreement only exists once we provide a written proposal that you accept and sign. Estimated response times listed on the Site (such as "we'll respond within one business day") are targets, not guarantees.
4. Intellectual Property
All content on this Site — text, images, graphics, logos, the Kingdom Konstruction name, and the crown mark — is owned by Kingdom Konstruction or licensed to us, and is protected by U.S. and international copyright and trademark laws. You may not copy, reproduce, distribute, or create derivative works from Site content without our written permission, except as permitted by fair use.
5. Third-Party Services
The Site uses third-party services for analytics, advertising, form handling, and address autocomplete (Google Analytics, Google Ads, Google Maps, Google reCAPTCHA, and Web3Forms). Your use of those features is also governed by those providers' terms and privacy policies.
6. Disclaimers
The Site and its content are provided "as is" without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do our best to keep Site information accurate, but we don't warrant that the Site will be uninterrupted, error-free, or virus-free.
Construction techniques, code requirements, and pricing change. Anything you read on this Site is general information only — it's not engineering advice, legal advice, or a substitute for a professional site assessment.
7. Limitation of Liability
To the maximum extent permitted by law, Kingdom Konstruction is not liable for indirect, incidental, special, or consequential damages arising out of your use of the Site, including loss of data, lost business, or lost profits. Our total liability for any claim arising out of your use of the Site is limited to one hundred U.S. dollars ($100).
8. Indemnification
You agree to indemnify and hold harmless Kingdom Konstruction, its owners, employees, and contractors from any claims, damages, or costs arising out of your violation of these Terms or your misuse of the Site.
9. Privacy
Your use of the Site is also governed by our Privacy Policy, which explains what information we collect and how we use it.
9a. SMS / Text Messaging Terms
By providing your mobile phone number to Kingdom Konstruction through a Site form, by replying YES to a confirmation text, or by signing a service contract that includes SMS authorization, you agree to the following terms in addition to our Privacy Policy SMS clause:
- Program description. Kingdom Konstruction sends SMS messages related to inspections, estimates, scheduled appointments, project status updates, and customer-service replies. We do not send unsolicited marketing or promotional messages.
- Consent. Submission of a phone number on our forms with the SMS-consent checkbox marked constitutes your prior express written consent to receive text messages from Kingdom Konstruction at the number you provided. Consent is not a condition of purchase.
- Message frequency. Message frequency varies; typically 1 to 10 messages between project scheduling and completion. Frequency is not recurring on a fixed cadence.
- Carrier and data rates. Message and data rates may apply per your mobile carrier's plan. Kingdom Konstruction does not charge for the messages themselves. Standard carrier rates from your provider apply.
- Opt out (STOP). Reply STOP to any message at any time to unsubscribe. You will receive one final confirmation that you have been unsubscribed; after that, no further messages will be sent unless you re-enroll. You may also opt out at any time via our SMS unsubscribe page.
- Help (HELP). Reply HELP to any message for support. We will respond with instructions and an unsubscribe option. You can also contact us at (361) 244-1310 or info@kingdomkonstruction.com.
- Supported carriers. AT&T, T-Mobile, Verizon Wireless, Sprint, Boost Mobile, U.S. Cellular, MetroPCS, and most other US carriers. Carriers are not liable for delayed or undelivered messages.
- No third-party sharing. Kingdom Konstruction will not share, sell, rent, transfer, or otherwise disclose your mobile phone number or your SMS opt-in data to any third party or affiliate for their marketing or promotional purposes. Your number is transmitted only to our SMS service provider (Twilio) and your mobile carrier for the sole purpose of delivering messages you have consented to receive.
- Service provider. Kingdom Konstruction uses Twilio (A2P 10DLC registered) as our SMS service provider. Twilio's privacy and security practices are described at twilio.com/legal/privacy.
10. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site shall be brought in the state or federal courts located in Nueces County, Texas, and you consent to the personal jurisdiction of those courts.
11. Changes to These Terms
We may update these Terms from time to time. The "last updated" date at the top of this page reflects the most recent change. Material changes will be communicated through the Site. Your continued use of the Site after a change means you accept the updated Terms.
